Dear Rob

Thank you for your email.

As requested, please find a copy of the text of your complaint below;

(Web url: http://cuttingcrime.conservatives.com)  The House of Commons Public Administration Select Committee heard evidence on Tues 19th Nov 2013 that UK crime statistics have been extensively distorted by 'gaming' due to pressure over many years from politicians of all parties. This renders the claims by current politicians of large reductions meaningless and highly suspect and impossible to substantiate. As this web site uses inevitably false crime figures as its primary attraction, it clearly now deceives the public. As an increase in party membership and so an increase in party subscription funding is the aim, visitors to the site should be told only what can be shown to be true - otherwise a charge of fraudulent exploitation could be demonstrated as occurring.

Hi. Thank you for your response and explanation, below. Please could a copy of the text of my complaint no. A13-251640 be emailed to me, as I've no copy of it.

I will try to take it further in some other way, especially as the police crime statistics have lost their badge of approval from the UKSA and the methodology, applicable span periods & reduced sampling sizes of the crime survey now looks shaky too.

Also, as the crime figure trend for most developed countries has been downwards since at least 1995, it can't be right that any continuing fall in one country can be claimed as the consequence of the very recent policies of only one government, in order to persuade the public to donate money to a political party.

I expected the text to be confirmed in the 'complaint acknowledgement' (received 26/11/13) or available to reference on the ASA web site but see that it isn't your policy to list complaints there.

Many thanks
Best regards

Dear Rob

Your complaint about Conservative Party

Thank you for contacting the Advertising Standards Authority with your concerns.

I’m sorry to inform you that we are unable to pursue your complaint on this occasion.  As the ASA is a self-regulatory body, we have been advised that under the freedom of speech provisions in the Human Rights Act 1998, we are unable to regulate ads that intend to affect voters taking part in the democratic process.  As such the UK Code of Non-broadcast Advertising Practice, Sales Promotion and Direct Marketing (CAP Code) has since contained the following rule, removing such material from our remit;

7.1       Claims in marketing communications, whenever published or distributed, whose principal function is to influence voters in a local, regional, national or international election or referendum are exempt from the Code.

Given this, and that the principle function of this ad appears to be to influence the voting public, I’m afraid that we can’t pursue your complaint further at this time.

I’m sorry that we are unable to assist you further in this instance but I would like to thank you nonetheless for taking the time to share your concerns with us.

Yours sincerely
X
